These terms and conditions outline the rules and regulations for the use of Solitaire Jewellery's Website, located at solitaireantwerp.com.

By accessing this website we assume you accept these terms and conditions. Do not continue to use Solitaire Jewellery Antwerp if you do not agree to take all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "Your" refers to you, the person log on this website and compliant to the Company’s terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Belgium. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Users should also note that the company reserves the right to do any alteration in these terms and conditions when necessary, and it expects such changes to take effect as soon as it has posted them on the website. Thus, it is the responsibility of users to read the terms and condition any time they want to use this website since the latest term and conditions bound them each occasion they use the site.

Purchase at Solitaire 

All details necessary to complete your order will be set when you are placing the order. Correspondingly, Solitaire Jewellery will send an email acknowledging the purchase and give all details about the products you have purchased. 

You cannot access the details concerning their purchase on their website. Following this, it is advisable for you to make a copy of the “Acknowledgement of purchase” email to serve as your personal records. You can also obtain the specific details of your previous transaction by contacting the company.

Delivery 

Solitaire Jewellery is only available to ship jewellery to clients in places where Fed-Ex, UPS and Malca-Amit offer a normal delivery service. 

You will get the estimated time scale as well as the delivery charges when you have placed an order. Solitaire Jewellery has a history of making every effort to meet the expected timescale when delivering goods to its customers. However, unforeseen factors may occasionally lead to delay or even delivery failure. If so, Solitaire Jewellery takes no liability. You can collect your orders by hand, directly from Solitaire Jewellery after representing an applicable proof of identities like an Identity Card/Passport.

Information, pictures, descriptions, videos on the website of Solitaire Jewellery or the information given by email, by chat communication - and/or by phone are as precise as possible. Solitaire Jewellery can not be held liable for mistakes, clerical errors, faulty mentions or lack of information.
When the client faces unclear information he can always contact a representative of Solitaire Jewellery.

Solitaire Jewellery passes any risk of loss or damage during the product(s) delivery to the buyer.

Solitaire Jewellery exerts herself to give a realistic and detailed picture of her products on her website. It could happen that a product is enlarged or reduced on the picture in order to allow the client to have a detailed view of the product. The client must be aware that each screen is calibrated in a different way so that image and colours can be slightly different from reality. The delivery agents will deliver the goods to the address provided by you when placing the order. Solitaire Jewellery assumes that a certain order is delivered when the agent delivers it to the delivery address, or, in case the agent fails to deliver the goods to your address and leave it at another address, you collect it from there. The delivery agent will notify you to collect your order within the next five working days. If you fail to collect the order within this period, Solitaire Jewellery will consider the delivery process as successful, and you can only do any return as per the return policy discussed later. You will sign a delivery note on collecting the order.

Acceptance/Payment for an online order

Once Solitaire Jewellery receives your order, it checks your debit/credit card as well as whether the stock is available. Goods are always subject to availability. Solitaire Jewellery can then deduct the payment from the card if the goods needed are available. Solitaire Jewellery will inform you in case they are unable to supply the products as soon as it can. In such a case, a full refund will be given to you, if you have already paid for the goods.

The prices of products as displayed on Solitaire Jewellery's website are exclusive of the VAT as well as delivery charges, except when expressly stated. 21% VAT (according to the Belgian Law) will be added to European Union (EU)-Customers (Billing and/or Shipping Addresses are within EU-Countries). Customers outside of the EU (Billing and Shipping Addresses are non EU-Countries) are free of the VAT and therefore will not be charged 21% VAT. However, customers outside of the EU (Billing and Shipping Addresses are non EU-Countries) must expect that import duties, taxes and/or even possible luxury taxes outside the EU can be levied by the customer in the respective country. Therefore Solitaire Jewellery assumes no responsibility or any other risks with regard to the goods, money and return, in case of non-payment of your duties and taxes. Solitaire Jewellery has the freedom to cancel your order and shall give back the money received from you, within 120 days after the payment date to your nominated bank account. You agree that Solitaire Jewellery has no liability to you in any event that leads to losses, expenses, and damages by using their website. 

You also agree to indemnify Solitaire Jewellery for all costs and outgoings it incurs in completing a failed payment process.

Methods of Payment 

The client, who received and unconditionally accepted an offer of Solitaire Jewellery, can pay in the following ways:

- Bank transfer

- Visa, ChinaUnionPay, Maestro, Mastercard, American Express, Bancontact or Paypal

When payment is done by credit card, the conditions of use of this card are determined by the card issuer. Solitaire Jewellery is not involved in the relation between the client and the card issuer. Solitaire will never take on its behalf any bank fees that may be charged by the customer’s bank. These bank fees will eventually be on behalf of the customer.

Returns/Substitutions

Customers of Solitaire Jewellery are requested to inspect the purchased jewellery immediately after delivery. Under penalty of preclusion, assertions about flaws/errors of the purchased items must be declared in written form to a Solitaire representative within a period of 5 days after delivery. The product(s) must be reshipped to Solitaire's Jewellery shop located in De Keyserlei 74B, Antwerp, Belgium. Solitaire will not be held responsible for the reshipment of the purchased item(s) nor will it intervene in the insurance coverage of any of the returned jewellery piece(s). Solitaire Jewellery offers an opportunity of a full-unrestricted refund to you within 30 days of delivery date. This return policy is restricted to:

  1. Any item with the product price that was not exceeding 3.000,- Euro (EUR) during the time of purchase excluding VAT. Otherwise, the period is reduced to within 14 days of delivery date.

  2. Items that are still in their original state or as they were displayed on their website, and without any customisation or damages.

  3. Discounted products for which the return policy is always restricted to within 14 days of delivery date.

  4. Fully set eternity bands with diamonds or gemstones. These cannot be resized, and for this reason cannot be returned.

  5. Custom made jewellery, for which you have ordered the good(s) according to your preferences and dimensions. Therefore Solitaire Jewellery cannot offer you a return for this product.

  6. Milgrain or ornate wedding bands cannot be returned nor can they be resized. 

In the circumstances that the delivered piece(s) of jewellery turn to be flawed, damaged or in the case it is not what the client has ordered, a representative of the Solitaire-team will offer the client to send the purchased item back. Solitaire's Product Manager will inspect and authenticate all returns from customers. The returned jewel(s) must be accompanied with the complete packaging, document(s), certificate(s) and box(es). Earrings will not be accepted for returns as a result of aesthetic and health reasons. Solitaire recommends all of its clientele to not use "Solitaire Jewellery" on the packaging of their returned goods for the sake of security reasons.

Solitaire Jewellery cannot be held responsible, under any circumstances, for damage/loss of returned products or late delivery of the customer's order. Solitaire Jewellery will retain the ownership of jewellery items that you have paid for in full. If you have received jewellery items you have not paid for, and Solitaire Jewellery requests you to return these goods, you should do so instantly. The price paid by the customer will be reimbursed within ten working days after a valid control of the conditions of the returned jewel(s). If the returned piece(s) of jewellery is decreased in value (inspected by Solitaire's Product Manager), the approximated loss of value will be subtracted from the purchased price and will be refunded to the customer.

Solitaire Jewellery will not be held to warranty/compensate the purchased jewellery item(s) in these cases:

- Normal or excessive wear and tear

- Improper use of the jewellery

- Physical damage (whether intentionally or not)

- Modification, or reparation of the jewellery item that has not be made by Solitaire Jewellery itself

- Tampering of the purchased item(s) made by a third party or the customer 

- In case of loss of one or more diamonds 

- Lacking of invoice(s) or certificate(s) of the purchased jewellery piece(s)

- Invoice(s) or certificate(s) of purchased item(s) that have become unreadable

Ring Measurements 

All jewellery measurements are approximate, nevertheless Solitaire Jewellery makes an effort of making sure that all ring sizes/jewellery measurements are accurate. In case of not knowing the size/measurement of a ring, Solitaire recommends its clientele to not make assumptions. Solitaire's standard ring sizes ranges between 49-54. Therefore, Solitaire Jewellery gives the opportunity where the customer reships the ring and the ring will be resized for free. Shipping, taxes and duties (if applicable) will have to be paid by the customer. In case the customer ordered a ring with a specific size and it turns out to be inaccurate, the customer will have to pay a maximum amount of 300 EUR,- (excluding VAT).

 

Reshipment charges

When the item must be returned, the customer can be requested by a representative of Solitaire Jewellery to reship the purchased product. In this case the customer must bear the charges of the reshipping.

Cost of repair

For jewellery pieces that customers wish to repair and are excluded from warranty, Solitaire Jewellery will send a quotation to the customer by mail. The customers can decline the quotation and not repair the jewellery item. The item will then be reshipped (at costs of the customer).

General Terms and Conditions 

Solitaire Jewellery rejects any liability for errors caused by temporarily unavailability of her website.

The customer acknowledges that intellectual rights concerning the name, all transmitted information, pictures, communications or other definitions concerning the products and/or in the website are and remain exclusive property of Solitaire Jewellery. Website users may not copy, distribute, reproduce, distribute, download, transmit, or display the content of Solitaire Jewellery's website by any means. 

Solitaire Jewellery cannot promise its site is free of bugs/viruses nor can it perform error-free functionality of the website. It is forbidden to use the commercial terms and brands "Solitaire Jewellery Antwerp" and "GLM Invest", to copy or reproduce under the Solitaire Jewellery brand nor is it possible to transfer any rights to third parties. 

The customer declares that the purchased jewellery items are only for personal purposes, not for business purposes. 

Solitaire Jewellery reserves the right to make alterations in these terms and conditions whenever necessary. You will be subjected to any of such changes whenever Solitaire updates its website. Accordingly, the customer must read the terms and condition every time they want to purchase a product or want to use the website. Solitaire Jewellery expects that those using the website have accepted to be bounded by the newest terms and conditions.
